Our Philosophy on Estate Planning

At Spahr Law, we believe that estate planning is not just about protecting your assets, it's about preserving your values. Do not fall prey to "one size fits all" planning strategies. Each family dynamic is unique, and your plan should reflect the characteristics and values of your family. From basic to advanced planning, we tailor our documents to meet your specific needs. Here are a few things that may separate your plan from others.

Minor children, troubled children, special needs beneficiaries, no children, adopted children, second marriages,  separate assets, business interest, out of state real estate, multiple pieces of real estate, substance abuse, re-marriage concerns, single property small estates

Basic Estate Planning

At Spahr Law, we believe basic estate planning should include the following:

Will, Durable Power of Attorney, Medical Power of Attorney, and Directive to Physicians

A will is an essential estate planning tool, but may not be cost effective in the long run. One must consider the attorney fees, court fees, and time associated with the probate process. These fees are in addition to the cost of creating a will. The probate process is public, costly and time consuming.

Basic estate planning works well for single property estates with few assets. We often employ additional estate planning tools such as a "Lady Bird Deed" to avoid probate.

Modern Estate Planning

Our most common form of planning is Modern estate planning. For a majority of our clients this is the most cost effective solution.

This is a comprehensive process that goes beyond simply distributing assets after death. Benefits to modern planning include, but are not limited to the following:

Probate avoidance, seamless financial management, avoiding incapacity issues, protecting assets for beneficiaries, asset management for minor children, wealth preservation, circumvent conflict among heirs, creditor protection and assignment of business interest.

This planning utilizes various trust along with all ancillary documents and is tailored to your unique needs and objectives.

Advanced Estate Planning

Advanced estate planning typically includes modern planning with a focus in one or more specific areas. This type of planning can be very technical and is used to address certain issues or assets of the estate. or Advanced planning may include some of the following:

Revocable trust, irrevocable trust, Medicaid trust, asset protection trust, Tax trust, advanced estate tax planning, business formation, business succession plans, company agreements, business formalities, business and personal property trust.

This planning may include a multi-trust structure, a multi-trust and business structure, or may incorporate a focused strategy to a basic or modern estate plan.

Advanced planning, such as, Medicaid and Asset protection planning can be quite complex. Other advanced planning may be as simple as the addition of an LLC to your current plan. We are dedicated to helping you achieve your estate planning goals.
